Domain Management Services

Important: Please read these terms carefully before using my domain management services. By using these services, you agree to be bound by these terms and conditions.
1. Definitions
In these Terms and Conditions:
- "Service Provider", "I", "me", "my" refers to Alan Tiller, a sole trader operating from the Isle of Wight, United Kingdom.
- "Client", "you", "your" refers to the person or entity purchasing domain management services.
- "Services" refers to domain management services including DNS management, domain renewals, and related administrative tasks.
- "Domain" refers to the domain name(s) being managed under this agreement.
- "DNS" refers to Domain Name System records and configuration.
- "Registrar" refers to the domain registrar where your domain is registered.
2. Service Description
Domain management services may include:
- DNS record management (A records, CNAME, MX, TXT, etc.)
- Domain renewal coordination and reminders
- DNS configuration for website hosting, email, and other services
- SSL/TLS certificate DNS validation
- General domain administration tasks
The specific scope of services will be detailed in your service agreement or invoice.
3. Domain Ownership
Important: You retain full ownership of your domain name(s). I act solely as a service provider managing DNS and administrative tasks on your behalf. I do not claim any ownership rights over domains managed under this agreement.
4. DNS Management
4.1 DNS Changes
I will make DNS changes as requested by you or as necessary for services I provide (such as hosting). You acknowledge that:
- DNS changes can take up to 48 hours (or longer) to propagate globally.
- During propagation, services may be intermittently unavailable or inconsistent.
- Incorrect DNS configuration can cause website downtime, email failures, or other service disruptions.
4.2 DNS Errors
IMPORTANT NOTICE: While I take reasonable care when configuring DNS records, I accept no liability for any issues, downtime, or damages arising from DNS configuration errors or changes.
5. Domain Renewals
5.1 Renewal Reminders
Where domain renewal is part of the agreed services, I will endeavour to:
- Monitor domain expiration dates.
- Send renewal reminders in advance of expiration.
- Process renewals upon your instruction and payment.
5.2 No Guaranteed Renewal
IMPORTANT NOTICE: I do not guarantee that domains will be renewed. It remains your ultimate responsibility to ensure your domains are renewed before expiration.
You acknowledge and agree that:
- Domain renewal requires timely payment from you.
- Renewal reminders may fail to reach you due to email issues, spam filters, or outdated contact information.
- I am not responsible for domains that expire due to non-payment, missed communications, or any other reason.
- Expired domains may be lost permanently and may be acquired by third parties.
- Domain recovery after expiration may be impossible or involve significant additional costs.
5.3 Renewal Costs
Domain renewal costs are set by the domain registrar and are subject to change. You are responsible for all renewal fees. I may charge an administration fee for processing renewals, which will be disclosed in advance.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- I shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the domain management services.
- I shall not be liable for domain expiration, loss of domain, or inability to renew a domain for any reason.
- I shall not be liable for any downtime, email failures, or service disruptions caused by DNS changes, propagation delays, or configuration errors.
- I shall not be liable for any actions, errors, or failures by domain registrars or other third-party providers.
- I shall not be liable for any loss of business, revenue, profits, data, or goodwill resulting from domain-related issues.
- My total liability for any claim arising from these Services shall not exceed the total amount paid by you for the domain management services in the twelve (12) months immediately preceding the claim.
7. Client Responsibilities
You are responsible for:
- Contact Information: Keeping your contact information up to date with me and your domain registrar.
- Renewal Payments: Providing timely payment for domain renewals when requested.
- Monitoring: Independently monitoring your domain expiration dates and not relying solely on reminders from me.
- Registrar Access: Maintaining access to your domain registrar account.
- Verification: Verifying DNS changes are correct and services are functioning after configuration changes.
- Authorisation: Ensuring you have authority to manage the domain and make DNS changes.
- Communication: Promptly responding to renewal notices and other domain-related communications.
8. Registrar Relationships
Your domain is registered with a third-party domain registrar. You acknowledge that:
- I am not the domain registrar and do not control registrar policies, pricing, or procedures.
- Registrar terms and conditions apply to your domain registration.
- Registrar actions, errors, or policies are beyond my control.
- Transfer, renewal, and other domain processes are subject to registrar procedures and timelines.
9. Domain Transfers
If you request domain transfer to another registrar or management provider:
- I will provide reasonable assistance to facilitate the transfer.
- Transfer completion depends on registrar procedures and is not guaranteed.
- Some domains may be subject to transfer locks or restrictions.
- Transfer fees charged by registrars are your responsibility.
10. Termination of Services
Upon termination of domain management services:
- You assume full responsibility for DNS management and domain renewals.
- I will provide reasonable assistance to transition management to you or another provider.
- You must ensure you have necessary access credentials for your registrar account.
- I am not responsible for any issues arising after services are terminated.
11. Indemnification
You agree to indemnify, defend, and hold harmless Alan Tiller from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the domain management services.
- Domain expiration or loss.
- DNS configuration changes requested by you.
- Disputes over domain ownership.
- Your violation of these Terms and Conditions.
- Any claims by third parties related to your domain(s).
12. Force Majeure
I shall not be liable for any failure or delay in performing my obligations where such failure or delay results from circumstances beyond my reasonable control, including registrar outages, internet infrastructure failures, or cyber attacks.
13. Payment Terms
- Management fees are payable as agreed in your service arrangement.
- Domain renewal fees must be paid before the renewal can be processed.
- Failure to pay renewal fees may result in domain expiration.
- Refunds are not provided for expired domains or unused management fees.
14. Changes to Terms
I reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the services constitutes acceptance of the modified terms.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with any applicable service agreements or invoices, constitute the entire agreement between you and Alan Tiller regarding domain management services and supersede all prior agreements and understandings.
